1. What is personal information?

In this policy “personal information” has the meaning set out in the Privacy Act. It is information or an opinion about an individual who is reasonably identifiable.  
 

2. What types of personal information do we collect?

The personal information we collect depends on the purpose of collection. We may collect:​

  • full name, date of birth and gender

  • place of residence (ordinary and temporary)

  • contact details such as postal address, email address and telephone number

  • government-issued identifiers, including passport details or driver's licence details

  • bank account details, credit card details or other payment account details

  • contractor or employee information (qualifications, resume, referees)

  • health-related information (where necessary, such as for safety briefings)

  • general analytics and technical details (IP address, device type, browser)

  • GPS tracking data generated by in-vehicle devices to enforce permitted driving areas
     

3. How do we collect personal information?

We collect personal information directly from you when you:

  • book or modify a vehicle hire through our website, over the phone, or in person

  • complete the Vehicle Incident Report Form following an accident or damage event

  • interact with our in-vehicle systems, including GPS units that record location data to monitor permitted driving areas

  • communicate with us by email, telephone, SMS or social media
     

We may also receive personal information from third parties, such as:

  • related companies or business partners who assist with bookings or customer service

  • insurers and repair/service providers when processing claims or arranging vehicle maintenance

  • government and law enforcement agencies issuing fines or infringement notices

  • publicly available sources and referees for contractor or employment vetting
     

Third-Party Cookies and Tracking Technologies

Adventure 4WD Hire uses the services of third-party vendors, who may implement persistent “Tracking Technologies” (cookies, eTags, pixels, local storage or similar) to recognise you and your device each time you visit our website. We use these technologies to:

  • remember preference settings

  • perform analytics and conversion attribution

  • reduce fraud
     

Advertisements or other services on our site may also include tracking technologies controlled by third parties. 4. Why do we collect, use and disclose personal information?

We only collect, use and disclose your personal information where we have a lawful basis, including: 

  • ​to perform our rental services and manage your booking and payments

  • to verify your identity and driver’s licence eligibility

  • to administer security bonds, process fines, tolls and other charges

  • to handle accident reporting, insurance claims and vehicle recovery

  • to meet our legal and regulatory obligations, including reporting to authorities

  • to improve our products, services and customer experience through analytics and direct feedback

  • to send you marketing communications where you have consented or it is otherwise permitted by law

 

5. To whom do we disclose personal information?

We may disclose your personal information to:

  • ​insurers, loss assessors and claims handlers for damage and accident processing

  • vehicle repairers, recovery operators and roadside assistance providers

  • government and law enforcement agencies for fines, infringement notices and regulatory compliance

  • related companies and service providers assisting with technology, data hosting, payment processing and customer support

  • our professional advisers (lawyers, accountants, auditors) and insurers for business administration

  • third parties you authorise, such as referees or booking agents

  • any other recipient as required or permitted by law

In all cases, we take reasonable steps to ensure that recipients handle your personal information in accordance with applicable privacy laws.


6. Does personal information leave Australia?

Adventure 4WD Hire stores personal information on servers located in Australia. However, we may disclose your information to overseas recipients (for example, cloud-service providers, insurers, or marketing platforms) to enable us to provide our products and services. Such recipients may be in various jurisdictions worldwide.

Except where an exception under the Privacy Act applies, we will take reasonable steps to ensure that any overseas recipient handles your information in accordance with the Australian Privacy Principles and any other relevant Australian privacy or data-security laws.


7. How do we protect your personal information?

We engage accredited service providers (for example, cloud-hosting, payment processors, data-archiving and analytics vendors) to store and process your information. We require them to implement reasonable technical and organisational measures (such as encryption at rest and in transit, access controls, audit logging and secure data-centre practices) to keep your data safe.

You should be aware that no security measure is completely foolproof. While we strive to protect your information, we cannot guarantee absolute security of any data transmitted over the internet. To the extent permitted by law, Adventure 4WD Hire excludes liability for unauthorised access to, disclosure of, misuse of or loss or corruption of your personal information.

Please notify us immediately if you become aware of any breach or security.

 

8. Direct marketing

We may use and disclose your personal information to send you direct marketing communications (offers, updates or newsletters) if:

  • you have expressly consented; or

  • it is otherwise permitted by law.
     

You can opt out of direct marketing at any time by:

  • clicking the unsubscribe link in any marketing email; or

  • contacting us directly (see Section 13).


9. How long do we keep your personal information?

We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected (as outlined in this policy), unless a longer retention period is required or permitted by law (for example, to comply with tax, contractual or statutory obligations).
 

When your information is no longer needed, we will take reasonable steps to delete it or permanently de-identify it.

 

10. Your rights

Access and correction

You may request access to, or correction of, the personal information we hold about you by contacting us (Section 13). We will respond in accordance with our legal obligations, subject to any permitted exemptions. We may require proof of identity before granting access.

Complaints

If you have a concern or complaint about our handling of your personal information, please contact our Data Protection Officer (Section 13). We will investigate and endeavour to resolve your complaint promptly.

If you remain unsatisfied, you may contact the Office of the Australian Information Commissioner (OAIC) on 1300 363 992 or at www.oaic.gov.au.

 

11. Local exemptions and inconsistencies

Where local laws permit an exemption from certain privacy obligations (for example, the employee-records exemption under the Privacy Act), we may rely on that exemption. To the extent this policy is inconsistent with any mandatory legal requirement, the relevant legislation prevails.

 

12. Changes to this policy

We may amend this policy from time to time. The “Last updated” date at the top will be revised accordingly. Your continued use of our websites, products or services after we publish changes signifies your acceptance of the updated policy.
